General Terms and Conditions (GTC)

1. Scope

1.1 These General Terms and Conditions (hereinafter "GTC") of MANePED GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller via the website www.nagelzange.de .

1.2 For the purposes of these Terms and Conditions, a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither attributable to their commercial nor their self-employed professional activity. A business is a natural or legal person or a partnership with legal capacity that, when concluding the contract, is acting in the course of its commercial or self-employed professional activity.


2. Conclusion of the contract

2.1 The products displayed in the seller's online shop do not constitute a legally binding offer, but rather a non-binding invitation to the customer to submit an offer.

2.2 The customer submits a binding offer to enter into a contract via the order form integrated into the online shop. The contract is concluded upon acceptance of the offer in the form of an order confirmation, delivery of the goods, or a payment request by the seller.

2.3 If PayPal is selected, the contract is concluded upon completion of the payment instruction.

2.4 The contract text is stored by the seller and sent to the customer by email after ordering.

2.5 The contract language is exclusively German.

2.6 The customer is obliged to provide a valid email address and to ensure that emails from the seller can be received (e.g. by using correct spam filter settings).


3. Right of withdrawal

3.1 Consumers generally have a right of withdrawal. Details can be found in the separate cancellation policy .

3.2 Products that are unsuitable for return for reasons of health protection or hygiene are excluded from the right of withdrawal , provided they are medical products used in contact with the body (e.g. pliers, milling cutters, instruments from the company RUCK).

3.3 The right of withdrawal for such products expires upon conclusion of the purchase contract , as reusability cannot be guaranteed for hygienic reasons.

3.4 The buyer will be informed of this exclusion during the ordering process. By submitting the order, he expressly acknowledges this exclusion.

3.5 The customer bears the costs of the return shipment unless there is a legal reason for return (e.g. defect).


4. Prices and Payment Terms

4.1 All prices are total prices including statutory VAT. Shipping costs are shown separately.

4.2 For deliveries to non-EU countries, additional costs may apply, e.g. customs duties or bank charges.

4.3 The available payment methods (e.g. credit card, Klarna, PayPal, SOFORT) are listed in the online shop.

4.4 When selecting payment service providers such as Stripe, Klarna or PayPal, their respective terms of use also apply.

4.5 If advance payment is agreed, payment is due immediately after conclusion of the contract.


5. Delivery and shipping conditions

5.1 Delivery will be made to the address specified by the customer.

5.2 In the case of PayPal payment, the delivery address stored there is decisive.

5.3 If a delivery fails because the customer has provided an incorrect delivery address or does not accept the package, he shall bear the resulting additional costs.

5.4 Self-collection is not possible for logistical reasons.


6. Retention of title

The goods remain the property of the seller until full payment has been received.


7. Liability for defects (warranty)

7.1 The statutory provisions regarding liability for defects apply.

7.2 Consumers are requested to immediately report any visible transport damage to the delivery person and inform the seller. This serves for traceability purposes and does not affect statutory rights.


8. Applicable Law

8.1 The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

8.2 For consumers with their habitual residence outside Germany, this choice of law applies only to the extent that it does not deprive them of the protection afforded to them by mandatory provisions of the law of their country of residence.

10. Alternative Dispute Resolution

10.1 The EU Commission provides a platform for online dispute resolution:

10.2 The seller is generally willing to participate in a dispute resolution procedure before a consumer arbitration board, but is not obligated to do so.


11. Use of customer data / communication

11.1 The seller uses the data provided by the customer to process the order and for delivery via our fulfillment partner Excellent GmbH and the shipping service providers used (e.g. DHL/DPD) . The email address may be transmitted to the shipping service providers to provide shipping information (e.g., package notifications).

11.2 With the customer's explicit consent, their email address will be used for:

  • the sending of newsletters via Klaviyo

  • Review requests via judge.me

  • Review invitations from Trustpilot

  • Invitation to Google review

11.3 This data processing is based on the customer's consent pursuant to Art. 6 para. 1 lit. a GDPR. This consent can be withdrawn at any time with effect for the future.
