General Terms and Conditions (GTC)

1. Scope of Application

1.1 These General Terms and Conditions (hereinafter "GTC") of MANePED GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods concluded by a consumer or entrepreneur (hereinafter "Customer") with the Seller via the website www.nagelzange.de.

1.2 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a legal partnership who, when concluding the contract, acts in the exercise of their commercial or self-employed professional activity.


2. Conclusion of Contract

2.1 The products displayed in the Seller's online shop do not constitute a legally binding offer, but rather a non-binding invitation for the Customer to submit an offer.

2.2 The Customer submits a binding contractual offer via the order form integrated into the online shop. The contract is concluded upon acceptance of the offer in the form of an order confirmation, delivery of the goods, or request for payment by the Seller.

2.3 If PayPal is selected, the contract is concluded upon completion of the payment instruction.

2.4 The contract text is stored by the Seller and transmitted to the Customer by e-mail after the order.

2.5 The contract language is exclusively German.

2.6 The Customer is obliged to provide a valid e-mail address and to ensure that e-mails from the Seller can be received (e.g., by correct spam filter settings).


3. Right of Withdrawal

3.1 Consumers generally have a right of withdrawal. Details can be found in the separate withdrawal policy.

3.2 Excluded from the right of withdrawal are products that are not suitable for return for reasons of health protection or hygiene, provided they are medical products used in body contact (e.g., pliers, cutters, instruments from RUCK).

3.3 The right of withdrawal for such products expires upon conclusion of the purchase contract, as reusability cannot be guaranteed for hygienic reasons.

3.4 The buyer is informed of this exclusion during the ordering process. By submitting the order, they expressly acknowledge this.

3.5 The costs of return are borne by the customer, unless there is a legal reason for return (e.g., defect).


4. Prices and Payment Terms

4.1 All prices are total prices including statutory VAT. Shipping costs are shown separately.

4.2 For deliveries to non-EU countries, additional costs may arise, e.g., customs duties or bank fees.

4.3 The available payment methods (e.g., credit card, Klarna, PayPal, SOFORT) are indicated in the online shop.

4.4 When selecting payment service providers such as Stripe, Klarna, or PayPal, their respective terms of use also apply.

4.5 If advance payment is agreed, payment is due immediately after conclusion of the contract.


5. Delivery and Shipping Conditions

5.1 Delivery is made to the address provided by the customer.

5.2 For PayPal payments, the delivery address stored there is decisive.

5.3 Non-collection / Return without Withdrawal

If the customer does not collect the goods, refuses acceptance, or if the shipment is returned to the seller for reasons for which the customer is responsible, there is no withdrawal.

In this case, the seller is entitled to deduct the incurred shipping costs (outbound shipping costs) of €4.50 and any return costs from the refund amount.

This also applies if shipping was originally offered free of charge.


6. Retention of Title

The goods remain the property of the seller until full payment.


7. Liability for Defects (Warranty)

7.1 The statutory provisions on liability for defects apply.

7.2 Consumers are requested to report recognizable transport damage immediately to the delivery person and to inform the seller. This serves traceability and does not affect legal claims.


8. Applicable Law

8.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.

8.2 For consumers habitually resident outside Germany, this choice of law only applies to the extent that it does not deprive them of the protection granted by mandatory provisions of the law of the state of residence.

10. Alternative Dispute Resolution

10.1 The EU Commission provides a platform for online dispute resolution:

10.2 The Seller is generally willing to participate in dispute resolution proceedings before a consumer arbitration board, but is not obliged to do so.


11. Use of Customer Data / Communication

11.1 The Seller uses the data provided by the Customer to process the order and for delivery via our fulfillment partner Excellent GmbH and the shipping service providers used (e.g., DHL/DPD). The e-mail address may be transmitted to the shipping service providers to provide shipping information (e.g., package announcements).

11.2 With the express consent of the Customer, their e-mail address will be used for:

review requests via judge.me

review invitations from Trustpilot

invitation for Google review

11.3 This data processing is carried out on the basis of the customer's consent in accordance with Art. 6 para. 1 lit. a GDPR. Consent can be revoked at any time with effect for the future.
